1. Learned advocate Mr.Kishan Prajapati has instructions to appear on behalf of the respondent No.2. He states at bar that he would file the Vakalatnama today. However, he has no objection if present application is allowed.

3. Considering the submissions made by the learned advocates for the respective parties as well as considering the explanation offered in the application, this Court deems it fit to allow this application.

4. Hence, present application is allowed. Delay of 236 days occurred in filing the criminal appeal is condoned. Rule is made absolute accordingly.
