ORAL ORDER
1. This is an application under Section 5 of the Limitation Act preferred by the applicant seeking condonation of delay of 43 days occurred in filing the criminal appeal challenging the judgment and order of acquittal dated 05.04.2023 passed by the learned 3rd Additional Chief Judicial Magistrate, Bharuch in Criminal Case No.10885 of 2021.

3. Considering the aforesaid submissions as well as explanation offered in the application coupled with the fact that length of delay is only 43 days, this Court deems it fit to allow this application.
4. Hence, present application is allowed. Delay of 43 days occurred in filing the criminal appeal is condoned. Rule is made absolute accordingly.
