Mr. Kirtidev Dave, learned advocate appearing for the petitioner submits that the petition is arising out from the Regular Civil Suit No.296 of 2017 pending before the learned 2nd Additional Civil Judge, Gandhidham, is now disposed of by judgment and order passed below Exh.1 on 21.06.2022 and therefore, present petition has become infructuous. He therefore seeks permission to withdraw the petition as this petition is filed against the interlocutory order.
Permission as prayed for is granted. The petition stands disposed of as having become infructuous. A copy of order passed below Exh.1 on 21.06.2022 by the learned 2 nd Additional Civil Judge, Gandhidham is taken on record. Notice is discharged.
