1. By way of present First Appeal, the Appellant / Original Plaintiff - Kalpeshbhai Parshottambhai Sidpara has challenged the judgment and order dated 21.8.2013 passed by the learned Principal Senior Civil Judge, Gondal in Special Civil Suit No. 66 of 2008, by which the Suit filed by the present Appellant / Original Plaintiff for declaration and permanent injunction against the Opponents / Original Defendants came to be dismissed.
2. The Appeal came to 'Admitted' on 5.3.2014. The Record and Proceedings was also received by this Court.
3. Learned Advocate Ms. Roma I Fidelis for the Appellant has filed a Note dated 19.1.2023, permitting the Appellant to withdraw the present Appeal in view of the settlement arrived at between the parties. Along with the Note, she had produced the settlement recorded by the Notary. 4. In view of the settlement, the Appellant is permitted to withdraw this Appeal. Appeal is dismissed as withdrawn. R&P be sent back.
