SUPEHIA) For the reasons recorded in the judgment, the following order is passed.
"The present appeal fails and the same stands dismissed. The judgment and order of conviction and sentence dated 31.08.2010 passed by the learned Sessions Judge, Bharuch, in Sessions Case No.80 of 2009 is hereby confirmed. It is reported that the appellant is on bail, this bail bond of the appellant shall stand cancelled. The appellant is, therefore, directed to surrender himself before the Jail Authority to undergo remaining sentence, if any, within a period of four weeks from the date of receipt of this writ, failing which the trial Court concerned is directed to issue non-bailable warrant against the appellant to effect his arrest.
Record and Proceedings, if any, be sent back to the trial Court concerned, forthwith.
