ORAL ORDER
1. RULE. Learned Additional Public Prosecutor waives service of Rule on behalf of the respondent-State.
2. The present petition is filed by the under trial prisoner through Jail, who is aged 31 years, seeking parole leave for a period of 30 days on the ground of death in the family and presence of the applicant is required for the various after death rituals. He was convicted for the offence punishable under Sections-376(D) and 114 of IPC by Additional Sessions Court, Vadodara, by judgment dated 19-10-2019. He was ordered to undergo imprisonment for 20 years.
3. In view of the aforesaid facts and considering the jail report , the petition is partly allowed. The under trial prisoner is Page 1 of 2 Downloaded on : Tue Jan 11 17:21:04 IST 2022 R/SCR.A/8878/2020 ORDER ordered to be released on parole leave for a period of Two Weeks from the date of his actual release, on his furnishing a personal bond of Rs.10,000/- (Rupees Ten Thousand Only) to the satisfaction of the jail authority, and on a further condition that he shall surrender to the Jail authorities on expiry of the parole leave period.
4. Rule is made absolute. Direct service is permitted.
