(PER : HONOURABLE THE CHIEF JUSTICE MR. JUSTICE VIKRAM NATH) Learned counsel Shri D.C.Sejpal at the outset stated that he may be permitted to delete opposite party No.1. Permission granted. The necessary incorporation be carried out within a week.

We have heard Shri D.C.Sejpal, learned counsel for the applicant.

Issue Notice to opposite party Nos.2 and 3 only at this stage fixing 12.02.2021. As the matter relates to post retiral benefits to be extended to the applicant under the judgment and order of the learned Single Judge dated 16.10.2019, which according to the learned counsel for the applicant has since not been complied with nor to the knowledge of the applicant any appeal has been preferred, we Page 1 of 2 Downloaded on : Mon Jan 04 21:08:45 IST 2021 C/MCA/842/2020 ORDER further direct that the opposite party Nos.2 and 3 would be free to ensure compliance by way of filing an affidavit to that effect by the next date failing which the Court may proceed further for framing of charges as prima­facie case for non­compliance is made out.
