Date : 19.07.2024 [Manish Choudhury, J.] This criminal appeal from Jail is directed against a Judgment and Order dated 08.11.2023 passed by the Court of learned Additional Sessions Judge [FTC-1], Margherita, District-Tinsukia in Sessions Case no. 02[M]/2017, arising out of Digboi Police Station Case no. 173/2016. By the Judgment and Order dated 08.11.2023, the accused-appellant has been convicted for the offence of murder under Section 302, Indian Penal Code, [IPC] and he has been sentenced to undergo rigorous imprisonment for life and to pay a fine of Rs. 5,000/-, in default of payment of fine, to suffer further rigorous imprisonment for another 6 [six] months.

2. The appeal is admitted for hearing.

3. The case records of Sessions Case no. 02[M]/2017 be called for.

4. Issue notice, returnable in 4 [four] weeks.

5. As Ms. A. Begum, learned Additional Public Prosecutor has appeared and accepted notice on behalf of the respondent, State of Assam, issuance of formal notice stands dispensed with.

6. The Registry to appoint an Amicus Curiae from the panel to represent the case of the accused- appellant.

7. List the appeal after 4 [four] weeks.
