Date : 04.01.2024 Heard Mr. A. H. Alamgir, learned counsel for the applicant. Also heard K. K. Das, learned Additional Public Prosecutor for the State.
This application has been filed under Section 389 of the Code of Criminal Procedure, 1973 for suspension of the sentence imposed on the appellants by the Judgment and Order dated 09.11.2023 which has been impugned by the appellants by preferring a criminal appeal which has been registered as Criminal Appeal No. 484/2023.
Issue notice to the respondents.
Since learned Additional Public Prosecutor has appeared for the respondent No. 1, no formal notice need to be issued to the respondent No. 1.
As regards the respondent Nos. 2 and 3 are concerned, the appellant shall take steps for issuance of notice to the respondent Nos. 2 and 3 by registered post with A/D within three days from the date of this order, returnable after three weeks.
The learned Additional Public Prosecutor submits that they will file written objection against the prayer for suspension of sentence.
Prayer is allowed.
The respondent No. 1 may file written objection before the next date fixed.
List this matter after three weeks.
