04.10.2023 Heard Mr. P. Borthakur, learned Additional Public Prosecutor, Assam, for the applicant.
This interlocutory application under Section 5 of the Limitation Act is preferred by Page No.# 2/2 the State of Assam for condonation of delay of 177 days in preferring criminal revision petition against the judgment and order passed by the learned Appellate court i.e. Sessions Judge, Nalbari, in Criminal Appeal No.25/2019, whereby the learned Court below has uphold the judgment and order of acquittal passed by the learned Additional Chief Judicial Magistrate, Nalbari.
Perused the petition and the documents placed on record. Let notice be issued, returnable in 4(four) weeks. Steps be taken upon the sole respondent by registered post with A/D and also by usual process within a week from today.
