04.10.2023 Heard Mr. A. Das, learned counsel for the petitioner. Also heard Mr. H.J. Tamuli, learned counsel for the respondents.

Mr. A. Das is permitted 4 (four) weeks time to implead the officer who is Page No.# 2/2 presently serving as the Director of Animal Husbandry and Veterinary Department, Khanapara Government of Assam.

Mr. H.J. Tamuli, learned counsel appearing on behalf of Mr. A. Sarma, learned counsel for the respondent submits that the present respondent has been wrongly impleaded as he was never holding the post of a Director of Animal Husbandry and Veterinary Department. It is submitted by the learned counsel for the petitioner that on a date when this Court passed the judgment and order dated 06.12.2017 in WP(C) no.7521/2017, the respondent was serving as the Deputy Director and as such, it is submitted that the directions passed in terms of the judgment and order dated 06.12.2017 was required to be complied with by the Director of Animal Husbandry and Veterinary Department and not by the Deputy Director. As such, the petitioner was wrongly impleaded the respondent in the petition.

Accordingly, Mr. A. Das, learned counsel for the petitioner is permitted 4 (four) weeks time to implead the Director of Animal Husbandry and Veterinary Department.

List the matter after 4 (four) weeks.
