01.06.2023 Heard Mr. A. U. Choudhury, learned counsel appearing for the petitioner as well as Mr. P. Borthakur, learned Addl. P.P. appearing for the State respondent no. 1.
The petitioner has filed this application under Section 401 read with Section 397 Cr.P.C against the impugned Judgment and Order dated 07.02.2023 in Criminal Appeal No. 10/2021 passed by the learned Sessions Judge, Nalbari, upholding the judgment and order dated 22.03.2021 passed in G.R. Case No. 657/2013 by the learned Judicial Magistrate First Class, Nalbari.
Issue notice to the respondent no. 2, returnable within 4(four) weeks.
The petitioner is directed to take steps for service of notice upon the respondent no. 2 by registered post with A/D as well as by usual process within 7(seven) days.
Call for the LCR.
