Date : 21.4.2023 Heard Mr. S. D. Purkayastha, learned counsel for the appellant and Mr. M. H. Rajborbhuyan, learned counsel for the respondents This second appeal is against the judgment and decree dated 17.6.2019 passed by the learned Court of Civil Judge, No.1 Cachar at Silchar dismissing the appeal being Title Appeal No. 38/2013 and the same is admitted on the following substantial questions of law:

Page No.# 3/3 Whether the impugned judgment and decrees passed by both the learned courts below in deciding the issue No. 6 is perverse inasmuch as the DW 1/DW 2 who are the brothers of the appellant, themselves had admitted that plaintiff is entitled for 1/11 th share of the land of their mother's property.
