30.11.2022 (Suman Shyam, J) Heard Mr. A. K. Purkayastha, learned counsel appearing for the petitioner. Also heard Ms. B. Bhuyan, learned senior counsel (Addl. P.P., Assam) assisted by Mr. J. Das appearing on behalf of the State.
This petition has been filed seeking leave of this Court to prefer an appeal against the judgment and order of acquittal dated 30.08.2022 passed by the learned Additional Sessions Judge, Goalpara in connection with Sessions Case No.24/2021 acquitting the accused persons.
We have perused the statements made in the leave petition.
Page No.# 4/4 Mr. Purkayastha submits that this proceeding arises out of the same incident involved in Crl. Appeal No.317/2022 pertaining to a separate F.I.R. and therefore, the matter calls for examination.
Issue notice returnable in four weeks.
Since Mr. Das has entered appearance and accepted notice on behalf of the respondent No.8/State, no formal notice is required to the sent to the said respondent. However, the petitioner to take for service of notice upon the respondent Nos.1 to 7 by registered post with A/D within a week from today.
This matter be henceforth tagged with Crl. Appeal No.317/2022.
