Date : 05-01-2022 Heard Mr. B.K. Bhagawati, learned counsel appearing on behalf of the applicants. Mr. P. Sharma appearing on behalf of the respondent/opposite-parties no. 1, 2, 3 and 4. Mr. D. Choudhury, learned counsel appearing on behalf of respondent no. 5 is present.
This is an application under Section 5 of the Limitation Act for condoning the delay of 4 days in filing the second appeal against the impugned judgment dated 15.11.2019 passed in Title Appeal No. 23/2018 by the Court of the Additional District Judge, Nagaon.
I have perused the said application and the ground assigned therein constitutes sufficient cause within the meaning of Section 5 of the Limitation Act. Accordingly, the delay of 4 days is condoned.
In view of the above, the Second Appeal be listed under Order XLI Rule 11 of the Code of Civil Procedure, 1908, on a date to be fixed by the Registry. IA stands disposed off.
