SANJEEV SACHDEVA, J. (ORAL) CM(M) 481/2020 & CM(M) 482/2020

1. The hearing was conducted through video conferencing.

2. Report has been filed by the Local Commissioner over e-mail of the Court Master and the same is taken on record.

3. The report indicates that the possession of the premises has been handed over to the petitioner.

4. In terms of the report, some of the articles found in the property have been released to the petitioner over Superdari.

5. Learned counsel for the respondents submits that the respondents do not claim any ownership rights on the said articles and has no objection in case the articles are released to the petitioner.

6. In view of the above, the Supurdginama is discharged. Petitioner is at liberty to deal with the articles in any manner the petitioner so desires.

7. It is informed that the issue with regard to the arrears of rent/damages to the property is pending before the Trial Court.

8. Trial Court is at liberty to proceed with the remaining issues pending before it in accordance with law.

9. In view of the above, no further orders are called for in this petition.

10. Petition is, accordingly, disposed of.

11. Copy of the judgment be uploaded on the High Court website and be also forwarded to learned counsels through email.
