1. Petitioner claims to be Director & Professor in Vinayaka Mission Homeopathic Medical College, Salem, Tamil Nadu, who is said to have applied for the post of Director, National Institute of Homeopathy (NIH) in pursuance of Advertisement of 14th August, 2017 (Annexure P-7). Petitioner claims that he is fully eligible to be appointed as Director in National Institute of Homeopathy in Kolkata.
2. It is the case of petitioner that despite being fully eligible, he has not been called for the interview, which is slated on 15th January, 2018 in Kolkata. Learned counsel for petitioner submits that petitioner has learnt from a colleague that he has got the interview call and the interview is to take place on the above-said date and venue. It is further submitted that in pursuance of Advertisement of 14th August, 2017 (Annexure P-7), W.P.(C) 333/2018 Page 1 of 2 petitioner had applied vide application (Annexure P-8) in August, 2017 and his colleague had received the interview call for the above-referred post just a week back. Learned counsel for petitioner submits that no prejudice would be caused if petitioner is also called for the interview and if it is not so done, then this petition would become infructuous.

In the facts and circumstances of this case, it is deemed appropriate to dispose of this petition with direction to first respondent to either call petitioner for the interview for the above-said post, if he is found eligible, or intimate petitioner within a week from today as to why petitioner has not been called for the interview.
4. With aforesaid directions, this petition and the applications are disposed of with liberty to petitioner to avail of the remedies as available in law, upon first respondent disclosing to petitioner, the reasons for not calling petitioner for the aforesaid interview.
5. Copy of this order be given dasti under signatures of the Court Master to learned counsel for both the sides.
