JUDGMENT
21.08.2018 SANJEEV SACHDEVA, J. (ORAL) CRL.M.C. 3014/2018 & 3038/2018 Page 1 of 3
1. Petitioners in Crl.M.C.3014/2018 seek quashing of FIR No.29/2012 under Sections 452/323/506/34 IPC at Police Station Jaffarpur Kalan and petitioner in Crl.M.C.3038/2018 seeks quashing of FIR No.63/2012 under Sections 323/341/452/506/34 IPC at Police Station Jaffarpur Kalan.
2. The parties are related to each other and are also neighbours. Subject FIRs which are cross FIRs were registered consequent to a quarrel that took place between the parties with regard to use of a common lane (gali) between the houses of the parties.
3. Learned counsels for the parties submit that the parties have settled their disputes with the intervention of other family members as well as members of the locality and the mediator. Parties assure that they shall maintain cordial relations and peace and harmony in the locality.
4. Parties were referred to mediation. Parties have settled their disputes through the process of mediation at Mediation Centre, Dwarka Courts, New Delhi on 15.03.2018.
5. Respective complainants are present in court in person, represented through their counsel and identified by the Investigating Officer. They submit that they have settled their dispute with the petitioners and do not wish to press the complaint against them any further.
CRL.M.C. 3014/2018 & 3038/2018 Page 2 of 36. In view of the fact that the disputes between the parties have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.
7. In view of the above, the petitions are allowed. FIR No.29/2012 under Sections 452/323/506/34 IPC at Police Station Jaffarpur Kalan and FIR No.63/2012 under Sections 323/341/452/506/34 IPC at Police Station Jaffarpur Kalan and the consequent proceedings emanating therefrom are, accordingly quashed.
8. Order Dasti under signatures of the Court Master.
