1. The petitioner is aggrieved by an interim order dated 14.9.2017, passed by the Delhi Co-operative Tribunal, on an application filed by the respondent No.2/Bank alongwith its appeal assailing an award dated 25.2.2017, passed in an arbitration case filed by the respondent No.1 herein.
2. After addressing arguments for some time, learned counsel for the petitioner states that he may be permitted to withdraw the present petition while reserving the right of his client to approach the court if aggrieved by the decision of the Tribunal in the appeal preferred by the respondent No.2/Bank. He requests that the Tribunal be directed to dispose of the pending appeal expeditiously.
3. The appeal was filed by the respondent No.2/Bank sometime in March, 2017. We understand that pleadings in the appeal have yet to be completed as no rejoinder has been filed by the respondent No.2/Bank W.P.(C) 9165/2017 Page 1 of 2 (appellant in the appeal). Learned counsel states that the coram of the Tribunal is not complete as a Member has retired recently. After the coram of the Tribunal is complete, it is requested to dispose of the appeal filed by the respondent No.2 (Appeal No.29/2017/DCT), as expeditiously as is possible.
4. The appeal is disposed of, along with the pending applications.
