% 31.05.2017 CM No.21760/2017 (exemption) Exemption is allowed subject to all just exceptions.

W.P.(C) 5072/2017

1. The petitioner, inter alia, seeks a direction to respondent Nos.1 and 2 to provide a copy of the Order-in-Original No.28/ZR/ADC/2015 dated 17.02.2015, issued by the Additional Commissioner of Customs (Preventive).

2. It is contended that the recovery proceedings have been WP(C) 5072/2017 Page 1 of 2 initiated against the petitioner based on the said order-in-original without the petitioner being supplied with a copy of the said order. The petitioner has made several representations, however, the copy has not yet been provided.

3. Learned counsel appearing for the respondents submits that the copy of the Order-in-Original shall be furnished to the petitioner within a period of one week from today.

4. The writ petition is disposed of with a direction to the respondents to serve a copy of the Order-in-Original to the petitioner, within one week from today. It is clarified that the petitioner would have the liberty to assail the Order-in-Original in accordance with law after the same is delivered to the petitioner.
