1. Counsel for the appellant hands costs of Rs.3,000/- to the counsel for the respondent in terms of the order dated 27.1.2017, which are duly accepted.
2. Counsel for the respondent states that he has no objection to the present appeal being disposed of in terms of the consent order dated 1.12.2016, passed in the lead case, RFA 192/2016 and the connected appeals filed by EDMC.
3. On enquiring, counsel for the appellant states that the estimated date for release of a sum of Rs.12,73,245/- to the respondent is April, 2019. He assures the Court that the appellant shall adhere to the terms and condition of the consent order passed on 1.12.2016.
4. In view of the aforesaid submission made by the counsels for the parties, the present appeal is disposed of, along with the pending application, in terms of the consent order dated 1.12.2016, passed in RFA 192/2016.
