HON'BLE MR JUSTICE SANJEEV SACHDEVA

                                 JUDGMENT

13.04.2017 SANJEEV SACHDEVA, J. (ORAL) W.P.(C) 991/2017 & CM No.12595/2017(delay in filing short- affidavit on b/o. respondent)

1. The petitioner, by the present petition, seeks a direction to the respondent to issue a passport to the petitioner pursuant to the application dated 28.01.2014.

2. Learned counsel for the respondent submits that there are certain objections in the application submitted by the petitioner. It is submitted that the petitioner had applied for the passport stating WP(C) 2929/2017 Page 1 of 2 marital status as "divorcee" without furnishing any supporting documents and the application of the petitioner has already been closed, as it is more than one year and the petitioner needs to apply afresh.

3. Learned counsel for the petitioner submits that the petitioner being an illiterate person had submitted the application through a representative. The representative, because of an error, clicked the option of 'divorcee' instead of „widow'. He submits that the petitioner would be applying afresh but with the marital status as „widow'. The statement is taken on record.

4. The petition is accordingly disposed of permitting the petitioner to make a fresh application to the respondents for issuance of passport. On receipt of the application, the respondents shall deal with the same in accordance with law.

5. Dasti under signatures of the Court Master.
