1. Present petition under Section 482 Cr.P.C. has been filed by the petitioner to challenge the legality and correctness of an order dated 18.08.2015 of learned Addl. Sessions Judge in Crl.Revision No.39/2015 whereby the order dated 21.04.2015 of learned Metropolitan Magistrate dismissing the application under Section 210 Cr.P.C. was upheld. Petition is contested by the respondent No.2.
2. I have heard the learned counsel for the parties and have examined the file.
Crl.M.C.4408/2015 Page 1 of 23. The judgment was reserved after hearing the arguments on 01.09.2016. Copy of the order dated 07.09.2016 of Co-ordinate Bench of this Court in Crl.M.C. 4555/2015 & Crl.M.C.4554/2015 'Ram Mohan Gupta vs. State & Anr.' has been placed on record. Similar contention was raised in the said proceedings.
4. By a detailed order dated 07.09.2016 the Co-ordinate Bench of this Court by discussing the factual aspects and legal position has dismissed both the said petitions. This Court finds no sound reasons to deviate from the said findings. In fact, the Courts below had dealt with all the three complaint cases together and a common judgment on the issue was delivered. Apparently, the present petition is connected with Crl.M.C. 4555/2015 & Crl.M.C.4554/2015 disposed of by the Co-ordinate Bench of this Court and is squarely covered by the order dated 07.09.2016.
5. In view of above, the present petition requires to be dismissed. Ordered accordingly.
6. Pending application also stands disposed of.
