JUDGMENT (ORAL)
1. The appellant has challenged the Claims Tribunal whereby compensation of Rs.76,698/- has been awarded to the respondent.
2. The accident dated 17th July, 2012 resulted in grievous injuries to the respondent who filed the claim petition before the Claims Tribunal. The Claims Tribunal awarded Rs.76,698/- along with interest @ 9% per annum to the respondent.
3. The respondent is present in Court and his injuries have been seen. This Court is of the view that the amount awarded to the respondent is just, fair and reasonable and the impugned judgment does not warrant any interference.
4. The appeal is, therefore, dismissed.
5. The appellant has deposited Rs.76,069/- with the Registrar General of this Court in terms of the order dated 10th August, 2016. The Registrar MAC.APP 581/2016 Page 1 of 1 General shall release the said amount to the respondent within two weeks.
6. The appellant shall file the computation of interest on affidavit within three weeks and the balance amount, if any, upon computation be directly paid to the respondent by means of a cheque by registered AD post. The appellant shall also send the copy of the affidavit to the respondent.
7. C.M. Appl. 27236/2016 is disposed of.
8. The statutory amount deposited by the appellant be refunded back to the appellant.
