1. Notice. Counsel for the non-applicant/plaintiff accepts notice and states that he has received a copy of the Chamber Appeal.

2. The present Chamber Appeal has been filed by the applicants/ defendants No.1, 2 and 4, who are aggrieved by the order dated 11.3.2016 passed by the Joint Registrar, rejecting their application, registered as IA No.7852/2015 filed under Order I Rule 10 CPC, for deletion of their names from the array of defendants.

3. At the outset, Mr. Sengh, learned Senior Advocate appearing for the applicants states that the relief in the Chamber Appeal may be confined to the defendant No.4 alone, whose request for deletion of name, apart from that of defendants No.1 and 2 has been turned down.

4. Accordingly, the Chamber Appeal is confined to defendant No.4.

5. In the course of arguments, counsel for the defendants states on instructions that instead of pressing the present Chamber Appeal, the defendants may be permitted to reserve their right to have an issue framed with regard to mis-joinder of the defendant No.4 in the present suit.

5. While granting liberty to the defendants, as prayed for above, the present Chamber Appeal is disposed of.
