Learned counsel for the petitioner seeks leave to withdraw the present petition while reserving the right of his client to approach the court of the learned ADJ, North-West, Rohin Courts, Delhi where suit No.389/2004 is pending, for making a request to return the plaint to enable the petitioner to file the same before the court vested with the pecuniary jurisdiction to try and entertain it.

2. Leave, as prayed for, is granted. The petition is disposed of.
