1. That since by an order passed today, the petition filed under Section 11 (6) of the Arbitration and Conciliation Act, 1996 (in short the Act) has been dismissed, and consequently, the appointment of the arbitrator made by the respondent having been sustained, the captioned petition is placed before the learned arbitrator, who would treat the same as an application under Section 17 of the Act.

2. To be noted, this court has not, to date, passed any interim order in the petition. The learned arbitrator, accordingly, will be free to pass any order, which is deemed fit, in the facts and circumstances of the case, after giving due opportunity to the parties herein.

3. With the aforesaid observations in place, the captioned petition is disposed of.
