1. Learned counsel for parties state that the award dated 22.10.1994 is by the same Arbitrator who gave the award in FAO (OS) Nos.235/2005 and 377/2005. The judgment passed by the learned Single Judge is dated 06.06.2005.

2. Learned counsel for parties state that the scope of dispute is however the same as in the appeals referred to in the judgment delivered by us today in FAO(os) 235/2005. Therefore, decision in the said appeal would govern even these cases. Ordered accordingly.

3. The appeal and the cross appeal are accordingly dismissed leaving the parties to bear their own costs.

4. The full decretal amount deposited in this court, be released to the respondent with accrued interest thereon, if any.
