G. P. MITTAL, J. (ORAL)

1. The only ground in the Appeal is that the Appellants/Claimants who are the legal representatives of the deceased Suresh Chander have not been granted any interest from the date of filing of the Appeal till the deposit of the awarded amount.

2. The Claim Petition was instituted on 30.09.2010 and the award was passed on 30.09.2011 and thereafter the award amount was deposited in the Claims Tribunal. There is no ground so as to deny the interest to the Appellants.

3. In the facts and circumstances of the case, I would award an interest @ 7.5% per annum from the date of filing of the MAC APP 167/2012 Page 1 of 2 petition till the date of the payment.

4. The Respondent/Insurance Company is directed to deposit the amount within six weeks.

5. The Appeal is allowed in above terms.
