* The petitioner has sought a direction to the respondent to appoint the petitioner as Assistant Commandant in CPF as according to the petitioner he had successfully completed the examination in 2009.

The learned counsel for the respondents, who appear on advance notice, on instructions, states that the petitioner has been WP(C) No.7544/2011 Page 1 of 2 recommended for appointment to the post of Assistant Commandant in CPF and has produced the copies of letters dated 26th August, 2011 and 17th October, 2011.

The communication dated 17th October, 2011 in para 4 stipulates that BSF may finalize allotment for appointment of various participants to CPF in consultation with Ministry of Home Affairs and the work be taken up immediately and the commission be informed of the allocation.

Para-6 of the said communication also categorically stipulates that the candidature of Shri Rajesh Kumar Arya (Roll No. 08537) is clear.

In view of the above said communications and the statement made by the learned counsel for the respondents, the grievance of the petitioner does not survive anymore and the writ petition is disposed of accordingly.

All the pending applications are also disposed of.
