The petitioner who was working as part time sweeper with the respondent-school from 01.02.1997 was disengaged on 31.10.2002.

The petitioner had raised a plea that he was not a part time sweeper but his services were engaged as attendant in home science laboratory.

The plea of the petitioner was repelled by the Tribunal and it was held that his engagement was dehors the rules and, therefore, the order terminating his services was in order and did not require any WP(C) 13296/2005 Page 1 of 2 interference by the Tribunal. The Tribunal had, thus, dismissed the original application.

No one is present on behalf of the petitioner. The writ petition is, therefore, dismissed in default of appearance of petitioner and his counsel.
