2. On 11.07.2011, counsel for the petitioner, on instructions, had stated that the petitioners did not want to pursue the petition as the relief sought has already been granted to the petitioner. Counsel had, however, sought time to file an affidavit in respect thereof.

3. A perusal of the record reveals that the affidavit to the effect that the petitioners do not want to pursue the petition has not been filed.
