* The respondent along with another HC Rohtas Singh and others were allegedly found conducting unauthorized checking of vehicles and realizing compounding amounts leading to disciplinary proceedings and imposition of punishment.

Co-accused/delinquent Sh. Rohtas Singh had filed an original application being O.A No.94/2007 against the punishment awarded to him, which was allowed by the Central Administrative Tribunal by order dated 30th June, 2009 and punishment imposed was set aside. Since the punishment awarded to the co-accused/delinquent was set aside, the Tribunal also set aside the punishment awarded to the respondent W. P. (C.) No. 243 of 2010 Page 1 of 2 by order dated 6th August, 2009 in O.A No.2585/2004 titled HC Suraj Bhan v. Commissioner of Police and Ors. It was also held that the respondent shall be entitled for all the benefits which had been granted to the HC Rohtas Singh in O.A No.94/2009. While deciding the petition the Tribunal has also held that the petitioner shall ensure that sealed covers in respect of the respondent shall be opened and if the respondent shall be found eligible, he would be given promotion as admissible by Rules.

Against the order dated 30th June, 2009 in O.A No.94/2007 which was passed in favour of HC Rohtas Singh, a writ petition being W.P(C) No.152/2010 titled Government of NCT of Delhi and Ors v. HC Rohtas Singh was filed which was also dismissed by this Court by order dated 12th January, 2010.

In the circumstances, there are no grounds to interfere with the order of the Tribunal dated 6th August, 2009 in O.A No.2585/2004 titled Suraj Bhan v. Commissioner of Police and Ors.

The writ petition in the facts and circumstances is without any merit and it is, therefore, dismissed.
