               ORDER

% 05.10.2009 The petitioner had filed objections to the draft Zonal Development Plan for Zone-J. However, it appears that the suggestions/objections were filed after the cut-off date and the same were not entertained by the Board of Enquiry.

This compelled the petitioner to file the present writ petition, in which allegations have been made that the draft Zonal Development Plan is in conflict to the Clause 3.2.1 of the Master Plan of Delhi-2021.

This Court while issuing notice in the writ petition vide order dated 20th August, 2008, had directed that the Board of Enquiry should examine the objections/suggestion given by the petitioner. Pursuant to the said directions, the petitioner was given a hearing by the Board of Enquiry. To WPC NO.6044-2008 Page 1 this extent, the grievance of the petitioner stands satisfied and has been redressed.

Draft Zonal Development Plan of Zone-J is yet to be notified and is pending consideration before the Central Government. I do not think it will be appropriate for this Court to entertain the present writ petition challenging the draft Zonal Development Plan. We do not know whether the draft Zonal Development Plan will be accepted or modified. It will be presumptuous to entertain the present writ petition.

The writ petition is accordingly disposed of with liberty to the petitioner to file a fresh writ petition after the Zonal Development Plan for Zone-J is notified. It is clarified that this Court has not expressed any opinion on merits and the contentions, raised in the writ petition.
