IA No.1950/2009

1. This application has been filed by the applicant/plaintiff on 4 th February 2009 for recalling an order dated 25th January 1996 i.e. after lapse of more than 13 years of the passing of the order. This application is liable to be dismissed on the sole ground of delay and limitation. Even a decree passed by the Court is executable only within 12 years of the order passed by the Court. By the impugned order, the award was made a rule of court. The order cannot be recalled on an application made after 13 years.

2. The application filed by applicant is hopelessly barred by limitation and is hereby dismissed on this sole ground.
