ORDER

After considering the judgment of Supreme Court in Abdul Gafur & Anr. v. State of Uttarakhand & Ors. (2008) 10 SCC 97, I consider that the suit prima facie is maintainable.

IA No. 14453/2009 (Exemption) Allowed subject to all just exceptions. CS(OS) No. 2127/2009 Let the plaint be registered as suit. Summons of the suit be issued to the defendants by ordinary process, registered A.D. as well as through approved Courier returnable for 24th February, 2010.
