1. The petitioners have filed this writ petition questioning the legality, validity and propriety of the order dated 31.12.2018 passed by the Divisional Joint Director, Health Services, Bastar Division.
2. Learned counsel for the petitioners submits that the order dated 17.12.2018 has been revoked by order dated 31.12.2018 without affording any opportunity of hearing to the petitioner and thereafter the counseling has already been done and selected candidates have already joined in the respective place of posting, therefore, the impugned order is unsustainable and the same is liable to be set aside.
3. Learned State counsel opposes the submission made by learned counsel for the petitioner and supports the impugned order.
4. I have heard counsel for the parties, considered their rival submissions made herein above and perused the material available on record with utmost circumspection.12
5. After going through the records, it is evident that the order dated 31.12.2018 has been revoked without affording any opportunity of hearing to the petitioners and the interim order granted by this Court remained in operation for a very long time vide orders dated 11.01.2019, 07.03.2019 & 14.03.2019 passed in WPS Nos. 157 of 2019, WPS No. 1580 of 2019 and WPS No. 1183 of 2019, respectively. In that view of the matter, the impugned order dated 31.12.2018 is set aside, however, the respondents are at liberty to pass fresh order if any administrative exigency so arises.
