1. This petition has been preferred by petitioner under Article 226 & 227 of the Constitution of India seeking following reliefs:- 2
"10.1 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ to the Respondent No. 1 to 3 to recall and/or quash the Impugned Email Communication dated 25.02.2026 [Annexure P/1], wherein a decision has been taken to declare the Petitioner's candidature as ineligible in relation to award of Rural Retail Outlet of Petrol Pump, without providing any opportunity to submit/upload the corrected/rectified documents, in the interest of justice.
10.2 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ to the Respondent Oil Marketing Company to accept the rectified/corrected Affidavit dated 08.08.2023 [Annexure P/7 (Colly)] as submitted by the Petitioner through his Representation dated 05.03.2026 in the interest of justice.
10.3 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ to the Respondent No. 1 to 3 to adjudicate/decide upon the Representation dated 05.03.2026 [(Annexure P/7 (Colly)] by accepting the rectified/corrected Affidavit dated 08.08.2023 in accordance with Rule 4, Note (Serial No. 3) at page 14 of the Guidelines on Selection of Dealers for Regular & Rural Retail Outlets through Draw of Lots/Bidding Process of the year 2023 in the interest of justice.
10.4 Any other relief, which this Hon'ble Court may deem fit and appropriate, according to facts and circumstances of the case may also be granted."

Learned counsel for the petitioner submits that, pursuant to the advertisement dated 28.06.2023 issued by respondent No.1, the petitioner submitted his application form online on 02.09.2023 for allotment of a Rural Retail Outlet Dealership at the location in between Meera Resort at Kudurmal to Urga Chowk, Urga, District Korba, Chhattisgarh. The petitioner was provisionally selected by the 3 respondents, which was communicated to him on 04.02.2026. He further submits that the petitioner also deposited a sum of Rs.40,000/- with the respondents. However, vide communication dated 25.02.2026 (Annexure-P/1), respondent No.3 informed the petitioner that he had been found ineligible on the ground that the Affidavit (Appendix-III) was uploaded by him after the date of application. He further submits that, as per Clause -4 of the said communication (Annexure -P/1), the petitioner was granted opportunity to file a representation by 07.03.2026; therefore, the petitioner has submitted the representation dated 05.03.2026 (Annexure-P/7) before respondent No.3, but the same has not been decided yet. Hence, learned counsel submits that, at this stage, this writ petition may be disposed of with a direction to respondent No.3 to decide the representation dated 05.03.2026 (Annexure -P/7) filed by petitioner within a stipulated period.
3. In reply, learned counsel for the respondents submits that the representation (Annexure-P/7) filed by the petitioner is under consideration and shall be decided by respondent No.3 in accordance with the applicable brochure guidelines within a period of two weeks.
4. Heard learned counsel for both the parties and perused the material available on record.
5. Having considered the submissions made by learned counsel for both the parties, and further considering the fact that the petitioner has already filed the representation within a stipulated period, the present petition is disposed of at this stage directing respondent No.3 to decide the representation dated 05.03.2026 (Annexure-P/7) filed by the petitioner, in accordance with the applicable law/rules/guidelines, expeditiously, preferably within a period of two weeks from today. 4
6. With aforesaid observation and direction, the writ petition stands disposed of.
7. Pending interlocutory application(s), if any, also stands disposed of. No order as to cost(s).
