The applicant has preferred this First Bail Application under Section 483 of The Bharatiya Nagarik Suraksha Sanhita (BNSS) for grant of regular bail, as he has been arrested in connection with Crime No.112/2025, registered at Police Station: Ambikapur District- Surguja (C.G.) for the offences punishable under Sections 21(c) and 22(c) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, "NDPS Act").

As per the prosecution story, on 10.07.2025, the ASI of Police Station Kotwali, Ambikapur, received a tip-off from an informant that on the main road near Maulavi Bandh, Ambikapur, three persons, namely Anil Gupta, Chandan Soni, and the present applicant Ajeet Singh, were waiting with narcotic cough syrup and injections for sale. Acting upon the said information, the police reached the spot and conducted a search of the bag allegedly kept by them. During the search, 149 bottles of Wings RX 2 Codeine Phosphate & Triprolidine Hydrochloride Syrup Onerex TM (100 ml each), 100 pieces of Buprenorphine Maleate Injection IP, and 100 pieces of Pheniramine Maleate Injection IP (2 ml each), totaling about 16,100 ml, were allegedly recovered from the joint possession of the said three persons, including the present applicant. The said contraband was seized on the spot and, on that basis, an FIR was registered against the above-named co-accused and the present applicant under Sections 21(c) and 22(c) of the NDPS Act.

3. Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in this case. He further submits that the alleged contraband was not seized from the individual possession of the present applicant. He further submits that in the present case, the charge-sheet has been filed before the competent Court and the applicant has no previous criminal antecedents, and he is in jail since 20.02.2025, further the conclusion of the trial is likely to take some time therefore, he prays for grant of bail.

On the other hand, the learned counsel for the State opposed the prayer for grant of bail and submits that the quantity of contraband articles seized from the joint possession of the present applicant and other co-accused persons, is above commercial quantity and further the bail applications of two co-accused persons has already been rejected by this Court vide order dated 01.09.2025 and 07.11.2025 passed in MCRC Nos. 6893/2025 and 8840/2025, hence, it is an organized crime, looking to the seriousness of this case, the present applicant is not entitled for grant of bail.

5. I have heard learned counsel for the parties and perused the material available on record.

Taking into consideration the facts and circumstances of the case, nature and gravity of offence levelled against the applicant and further the fact that the quantity of contraband article which is said to have been recovered from the joint possession of present applicant and co-accused persons, is above the commercial quantity, also considering the fact that the bail applications of two co-accused persons has already been rejected by this Court vide order dated 01.09.2025 and 07.11.2025 passed in MCRC Nos. 6893/2025 and 8840/2025, hence, it is an organized crime, looking to the seriousness of this case, this Court is of the opinion that it is not a fit case to release the applicant on bail.

Accordingly, the bail application of applicant - Ajeet Singh involved in Crime No.112/2025, registered at Police Station: Ambikapur District- Surguja (C.G.) for the offences punishable under Sections 21(c) and 22(c) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, "NDPS Act"), is rejected at this stage.

8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.

9. The Office is directed to provide a certified copy of this order to the trial Court for necessary information and compliance forthwith.
