ORDER
(Passed on 14th March, 2026)

2. The present writ petition has been filed challenging the arbitrary and illegal inaction of the respondent authorities in not granting and executing the fisheries lease of Ghongha Jalashay, District Bilaspur, in favour of the petitioners' Societies (Apex Committee), despite the petitioners having been declared eligible, local and suitable and recommended by the Selection/Scrutiny Committee on 20.06.2025 in accordance with the Chhattisgarh Fisheries Policy, 2022. Although pursuant to the public advertisement dated 25.05.2025 the petitioners were found fully eligible while Lokband Harijan Machhua Sahkari Samiti was declared non-local and ineligible, the respondents have failed to issue the lease/patta even after lapse of the prescribed period under the Chhattisgarh 3 Lok Seva Guarantee Adhiniyam, 2011 and have instead attempted to compel the petitioners to associate with the said ineligible society, which action is without jurisdiction, depriving the petitioners' members of their livelihood and violating Articles 14 and 21 of the Constitution of India.
3. Today, both the parties filed compromise application stating that the grievance of the petitioner has been redressed. Lease has already been granted in favour of the petitioner and accordingly the agreement was executed for fishing operation, the petitioner society has already started fishing operation since 16.02.2026. Hence both the parties compromised the dispute amicably and as such nothing remains in this petition for adjudication.
4. The contesting parties to this petition have amicably settled/compromised the dispute. We have also found that the terms and conditions of compromise/settlement arrived at between the contesting parties are just, proper and legal and hence are acceptable. We accordingly accept the compromise/ settlement, proposed by the parties.
5. A copy of this compromise/docket arrived at by the parties be made part of this record.
6. Accordingly, the instant petition is disposed of on the basis of said compromise deed.
