1) The present Appeal has been filed by the appellants/efendant against the impugned judgment and decree dated 28.3.2017 passed by the District Judge, Bemetara CG) in Civil Suit No.8A/2013, whereby the suit has been decreed in favour of the plaintiff/respondent No.1 and defendants 1 to 3 have been directed to execute and register the sale-deed with regard to the subject property.
2) Both the parties have filed compromise application stating that the grievance of the appellant has been redressed and an amount of Rs.2,50,000/- has been received by respondent No.1 - Damman Singh and now, there is no dispute between the parties. It is 3 further stated therein that the appellants and the contesting respondents reside in the same village and during pendency of the instant appeal, they have amicably settled the dispute out of Court. This settlement was reached on their own free will and consent, without any protest or duress. Consequently, a written compromise deed has been executed.
3) The relevant excerpt of the Compromise dated 10.3.2026 reads as follows :
1. यह कि पक्षकार क. (ब) के द्वारा पक्षकारगण कमांक (अ) के विरूद्ध विनिर्दिष्ट अनुतोष अधिनियम के तहत ख.नं. 248 रकबा 0.50 एवं 072 एकड़ कृ षि भूमि के संबंध में व्यवहार वाद क्रमांक 08-A/2013 माननीय जिला न्यायाधीश बेमेतरा के समक्ष प्रस्तुत किया था जो पक्षकार कमांक (ब) के पक्ष में निर्णित हुई थी, जिससे क्षुब्ध होकर पक्षकारगण क. (अ) ने माननीय (छ.ग.) उच्च न्यायालय के समक्ष प्रथम अपील क्रमांक 245/2017 प्रस्तुत किया था जो विचाराधीन है।
2. यह कि प्रकरण की परिस्थिति एवं वाद लम्बन अवधि को देखते हुए उभय पक्षकारगण आपस मे समझौता कर उपरोक्त प्रकरण को आपसी राजीनामा के शर्त अनुसार पूर्ण रूप से समाप्त करना चाहते है।
3. यह कि पक्षकारगण कमांक (अ) पक्षकार कमांक (ब) को वाद मूल्य की राशि 1,39,000/- (एक लाख उन्तालिस हजार रूपये) को बढ़ाकर 2,50,000/-(दो लाख पचास हजार रूपये) जिसमें 4 आज तक का ब्याज सम्मिलित है को नकद रूपये 2,50,000/-
(दो लाख पचास हजार रूपये) पक्षकार कमांक (ब) को पक्षकारगण कमांक (अ) के द्वारा आज दिनांक 10/03/2026 को दो गवाहो के समक्ष दिया गया
4. यह कि उभय पक्षकारगण उपरोक्त न्यायालयीन वाद को आपस मे सहमत होकर पूर्ण रूप से समाप्त कर लिये है एवं उपरोक्त वाद बिंदु के आधार पर भविष्य मे कोई दावा या वाद-विवाद नही करेंगे। यदि उभय पक्षकारगण के द्वारा अथवा इनके वारीसान के द्वारा इसी बिंदु पर कोई दावा या विवाद किया जायगा तो वह प्रारंभ से ही शुन्य व नाजायज होगा।
5) यह कि उभय पक्षकार राजी खुशी से होस हवास मे रहकर स्वतंत्र सहमति से एवं बिना डर भय के न्यायालयीन प्रकरण कमांक F.A. No. 245/2017 को आपसी राजीनामा के आधार पर समाप्त कर रहे है।
4) The contesting parties to this appeal have amicably settled/compromised the dispute. We have also found that the terms and conditions of compromise/settlement arrived at between the contesting parties are just, proper and legal and hence are acceptable. As the parties have amicably settled the dispute, nothing remains in this appeal for adjudication. We accordingly accept the compromise/ settlement, proposed by the parties.

5) In light of the settlement arrived at between the parties, it is directed that the Court Fees be refunded to the appellant as per rules.
6) A copy of this compromise/docket arrived at by the parties shall be made a part of this record.
7) In view of the above, the Appeal is disposed of in terms of the compromise.
