1. This is an office reference.
2. Perused the office note filed by the Registry. Learned Principal Judge, Family Court Durg has sent request letter dated 13.02.2026 seeking extension of time to decide Civil Suit No.369/2025 in compliance of order dated 13.10.2025 passed in MCC No.1035/2025 (which was filed in connection with order dated 27.03.2025 passed in TPC No.18/2025), whereby, this Court has directed the concerned Court to conclude the case preferably within a period of 4 months.
3. In the request letter, learned Family Court has assigned the reason that 2 parties are taking time again time for settlement, due to which, case could not be decided.
4. It is surprising that, despite a lack of positive conduct toward a settlement, the parties continue to take adjournment and the Family Court persists in granting such adjournments. This is a matter of concern as such apathy toward the timely resolution of the case cannot be appreciated. However, on due consideration this Court is inclined to grant further time of 4 months to decide the said case.
5. However, this Court observes that since this is the third extension, if the case is not decided within further period of extended time, then the concerned Family court shall send copy of all order-sheets of the case, so that his concerned to decide the matter in expeditious manner can be examined. It is also expected from the concerned Family Court that it shall not take lenient approach in the matter and proceed expeditiously in accordance with law.
6. With the aforesaid observation, prayer for extension of time is allowed.
Further time of 4 months' from today is granted to decide the said case, in compliance of order dated 27.03.2025 and subsequent order dated 13.10.2025.
7. Registry shall send copy of this order to the concerned Court forthwith.
8. Accordingly, the MCC stands disposed of.
