1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.170/2025 registered at Police Station - Gidhauri, District:
Balodabazar-Bhatapara, C.G. for the offence punishable under Sections 318(4), 3(5), 111 of BNS.

Case of the prosecution, in brief, is that the complainant Deepak Kumar Dansena lodged the written complaint stating that the main accused Ramnarayan Sahu has received the amount Rs. 2 1,58,45,000/- from the complainant and Rs. 93,10,000/- from his friend Vijay Kumar Sharma in his account and the account of the other co-accused and gave the assurance that he will invest the amount in the Share Market and the amount will be doubled in further 25 months. That on the assurance of the accused Ramnarayan Sahu, the complainant has received the amount from his family members and gave it to the accused Ramnarayan Sahu but he failed to return the amount and the main accused Ramnarayan Sahu has committed fraud with him and complaint of the complainant P.S. Gidhauri registered the Crime No. 170/2025 for the alleged offence punishable U/s 318 (4), 3 (5), 111 of B.N.S. against the main accused Ramnaranyan Sahu and another and after investigation filed the charge sheet against him but presently sent the notice to the present applicant regarding his involvement in the alleged crime, despite the fact that the applicant has not committed any offence as alleged against him, that the applicant is victim and he has alsogiven Rs. 56,60,000/- to the main accused Ramnarayan Sahu and when he failed to return the amount, the present applicant has also lodged the written complaint against Ramnarayan Sahu on 29.09.2025 before the Superintendent of Police Baloda Bazar, Dist- Baloda Bazar-Bhatapara. That the applicant has taken a loan and then given the said amount to the main accused Ramnarayan Sahu.
3. Learned counsel for the applicant submitted that applicant is innocent and has falsely been implicated in the present case. He also submits that applicant is victim and he has also given Rs.56,60,000/- to the main accused Ramnarayan Sahu and when he failed to return the amount, the present applicant has also lodged the written complaint against the Ramnarayan Sahu on 29.09.2025 3 before the Superintendent of Police Baloda Bazar, District - Baloda Bazar. He further submits that only of the basis of memorandum statement of co-accused, applicant has implicated in crime in question. He further submits that earlier the submission made by the learned counsel for the State, there are three criminal cases registered against the applicant, they investigated the same but all the three cases are not related to the present applicant. Therefore, he submits that the present applicant is also entitled to be released on anticipatory bail.
4. On the other hand, learned State counsel, appearing for the non -
applicant/State, opposes the prayer for grant of anticipatory bail to the applicant.
5. I have heard learned counsel for the parties and perused the materials available on record.

Considering the facts & circumstances of the case, submission of learned counsel for the parties, materials available on record, considering the fact that only on the basis of memorandum statement of co-accused, he is implicated in this case, moreover, earlier the submission made by the learned counsel for the State, there are three criminal cases registered against the applicant, but all three cases are not related to the present applicant. therefore, I am inclined to grant anticipatory bail to the present applicant.
7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant - Sampat Kumar Sahu, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:-

(a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court.
(b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial.
(c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
(d) The applicant and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
(e) The applicant shall not involve himself in any offence of similar nature in future.
