From perusal of records, it is clear that the petitioners were stood on 6th & 7th position in the list declared by the respondents for appointment on the post of Rural Health Coordinator (Women) ST category, but when selection list was declared, the petitioners have placed in serial No. 2 & 3 in the wait list.
In pursuance of the direction issued by this Court, Chief Medical and Health Officer, Bastar at Jagdalpur-Dr. R.K. Chaturvedi is appeared before this Court and informed that in pursuance of the circular issued by State of Chhattisgarh on 07.12.2021, 10 marks has been granted to the persons who have worked in Covid pandemic. This marking pattern was not provided in the advertisement and after issuance of advertisement, they have changed the rules, which is prima facie not permissible under the law. Prima facie, it reflects that this rule has been changed during pendency of the selection process, Page 2 of 2 which is deprecated by Hon'ble the Supreme Court in various judgments.
Considering this aspect of the matter, the State is directed to inform this Court within two weeks whether they can create supernumerary posts for considering the case of the petitioners.
List this case on 22nd August, 2022.
