Mr. Kashif Shakeel, Dy. A.G. for the State. Learned Senior counsel submits that the applicants have been tortured in the jail and at the time of arrest they were handcuffed which is clear violation of the Judgment of Supreme Court in the case of Sunil Batra Etc vs Delhi Administration And Ors. Reported in (1978) 4 SCC 494 & in the case of Democracy v. State of Assam & Others reported in (1995) 3 SCC 743.
Let the State submit a reply on the above allegation made by Senior counsel.
State counsel seeks two weeks time to make submission and file appropriate reply to these allegations supported by an affidavit.
