For decree holder THE COURT: Mr. Aritra Basu, learned advocate appearing for the decree holder submits that the present execution application has been field by decree holder for an amount of Rs.10,52,65,304/- towards mesne profit. The judgment debtor, Coal India Limited has failed to appear on the last occasion. He submits that the judgment debtor be directed to make payment of admitted dues. He also indicates that a copy of the affidavit-in-opposition has been served upon the learned advocate for the decree holder.
None appears on behalf of the judgment debtor. It is informed by the Court Officer that the affidavit-in-opposition is not available in the case file. On the last occasion, department was directed to 2 place the said affidavit-in-opposition. Accordingly, department concerned is directed to furnish a report as to whether any affidavit-in-opposition has been filed by the judgment debtor or not on the returnable date.
Let this matter appear on 10th September, 2024. The learned advocate for the decree holder is directed to indicate the next date of hearing to the learned advocate for the judgment debtor.
