Mr. Sengupta, learned counsel appearing on behalf of the petitioner relies on a judgment reported in (2005) 6 SCC 289 (Supriyo Basu and Others Vs. W. B. Housing Board and Others) and a judgment reported in (1999) 1 SCC 741 (U.P. State Cooperative Land Development Bank Ltd. Vs. Chandra Bhan Dubey and Others) and also a judgment reported in Manupatra 2006 (K. Marappan Vs. The Deputy Registrar of Co-operative Societies and Ors.) in support of his contention that the present writ petition is maintainable.
Mr. Bhattacharyya, learned counsel, appearing on behalf of the respondent nos. 6 to 9 relies on a 2 judgment reported in (2014) 1 CHN 44 (Thalappalam Service Cooperative Bank Limited & Ors. Vs. State of Kerala & Ors.) in support of his contention that the present writ petition is not maintainable being a dispute between a member of a cooperative society and the board of the said society.
