      The Court: This matter was fixed by this Court for hearing at 12:30 p.m.

today. Direction had been given on 22nd November, 2022 for filing affidavit-in-

opposition and reply thereafter.   Furthermore, direction had been given to file

notes of arguments along with the judgments by 16th December, 2022. It is to be

noted that neither party has filed their notes of arguments.    Furthermore, no

affidavit-in-opposition has been filed by the respondent and the counsel now

seeks extension of time to file the same.

It is to be noted that the matter was fixed for hearing at a specific time taking into consideration the convenience of both counsel. However, the lawyers 2 have chosen not to file any affidavit-in-opposition nor any notes of arguments. Further indulgence is sought by both the counsel.

Accordingly, let affidavit-in-opposition be filed within a period of one week from date; reply thereto, if any, within one week thereafter. Notes of arguments are required to be filed within two weeks from date.

Let this matter appear as a 'Specially Fixed Matter' in the monthly list of February, 2023.
