This is an application for a direction upon the learned Special Judge (NDPS) Act, 6th Court at Barasat for expeditious disposal of NDPS Case No. 103 of 2021 under Section 21(c ) of the NDPS., Act.
It is submitted by the learned advocate for the petitioner that the petitioner was arrested in connection with this case on 18 th August, 2021. Since he is in custody, the Investigating Officer filed 2 supplementary charge sheet enclosing the chemical examination report of contraband articles on 16 th October, 2021. Thereafter, the learned Judge framed charge against the accused on 18 th January, 2023. There are eight witnesses to be examined on behalf of the prosecution. Out of them two witnesses have already been examined in part.
Considering the averment made in the instant revision this Court is of the view that the instant revision can be disposed of with the assistance of learned P.P.-in-charge. Accordingly, Ms. Jonaki Saha, learned advocate is requested to assist this Court on behalf of the prosecution.
Appointment of Ms. Jonaki Saha be regularized by the learned Legal Remembrancer, Government of West Bengal.
Having heard the learned advocate for the petitioner and the learned advocate for the State of West Bengal, this Court finds that the learned Special Judge, 6th Court at Barasat has already taken expeditious step for early disposal of the case. Only six witnesses are to be examined in the instant case. Therefore, I am not going to pass any time bound direction for disposal of the above mentioned NDPS case. However, the learned trial Judge is requested to take the same approach to dispose of the NDPS Case No. 103 of 2021 expeditiously.
With the above order, the instant revision is disposed of. 3 The petitioner is at liberty to act on the server copy of the order.
