The reasons so assigned in the application under Section 5 of the Limitation Act are found to be just and sufficient. As such, the prayer for condonation of delay in respect of 85 days, which took place for filing an application for Special Leave to Appeal is hereby condoned.

In Re: CRMSPL 14 of 2023 The subject matter of challenge relates to a judgment and order of acquittal dated September 28, 2022 passed in connection with Criminal Appeal No.99 of 2021 by the learned Additional District and Sessions Judge, 1st Fast Track Court, Calcutta.
In view of the reasons so assigned, the applicant is granted liberty to file the memorandum of appeal within a period of 30 days.
